Title Insurance
At Schecter Law, our Florida real estate attorneys routinely provide title examination and title insurance for our residential and commercial clients. The purpose of title insurance is to protect the purchaser of real estate and the holder of a mortgage against loss from defective titles, liens, and encumbrances. Protecting a buyer against loss is accomplished by the issuance of a title insurance policy. Since title insurance, as other forms of insurance, is a risk assumption, it is very important that the title insurer eliminate the risk and prevent losses caused by defects in title arising out of events that may have happened in the past.
At Schecter Law to achieve this goal we review an extensive search of the public records to determine that there are no adverse claims to our client’s interests. If we find there adverse are claims or other defects in title, we will seek to eliminate them prior to closing, and if they cannot be eliminated prior to closing, then with the client’s permission, they are excepted from coverage.
